By accessing or using Power of Sale Listings ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
Power of Sale Listings is a real estate listing aggregation platform that displays power of sale property listings sourced from Multiple Listing Service (MLS) databases and other public sources. We provide tools for searching, filtering, and receiving notifications about power of sale properties in Ontario, Canada.
3. User Accounts
Some features of the Service require you to create an account. When you create an account, you must:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.
4. Use of Listing Information
The property listings displayed on our platform are provided for informational purposes only. You agree to:
- Use listing information only for personal, non-commercial purposes unless otherwise authorized
- Not copy, redistribute, or publish listing information without permission
- Not use automated tools to scrape or download listing data
- Respect the intellectual property rights of MLS boards and listing agents
5. VOW Compliance
Certain listings on our platform are subject to Virtual Office Website (VOW) regulations established by real estate boards. By creating an account and agreeing to these Terms, you acknowledge that:
- You are accessing VOW listings for the purpose of considering real estate purchases
- You will not use VOW data for any purpose other than personal, non-commercial use
- You understand that registration is required to view complete VOW listing information
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- Listing information is accurate, complete, or current
- The Service will be uninterrupted or error-free
- Any defects in the Service will be corrected
- Properties listed are available for purchase or sale
Property information, including but not limited to prices, descriptions, square footage, and photos, may contain errors or be out of date. Always verify listing details with the listing agent or brokerage before making any decisions.
7. Limitation of Liability
To the fullest extent permitted by law, Power of Sale Listings and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any errors or inaccuracies in listing information
- Any unauthorized access to or use of our servers or your data
- Any real estate transaction or decision made based on information from the Service
8. Indemnification
You agree to indemnify and hold harmless Power of Sale Listings, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
9. Intellectual Property
The Service and its original content (excluding user-generated content and third-party listing data) are the property of Power of Sale Listings and are protected by copyright, trademark, and other intellectual property laws.
10. Third-Party Links and Services
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on the Service with a new "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
